Operation of food labeling standards based on the Food Labeling Law following the spread of new coronavirus infection (April 2020, 4: Consumer Affairs Agency, Ministry of Agriculture, Forestry and Fisheries, Ministry of Health, Labor and Welfare notification)

The Food Labeling Act (Act No. 70 of 2013) establishes Food Labeling Standards (Cabinet Office Ordinance No. 10 of 2015) to ensure the proper labeling of food products. Currently, as the global spread of COVID-19 is having a serious impact on domestic and international food supply chains, there are concerns that disruptions to the supply of food raw materials or additives (hereinafter referred to as "raw materials, etc.") will prevent food-related businesses considering switching raw materials, etc. from immediately responding to changes in container and packaging materials, leading to production delays and hindering the smooth production and distribution of food products. In light of the current situation where the spread of COVID-19 is affecting social and economic activities, and from the perspective of ensuring a food production system that meets the demands of general consumers, we will not enforce regulations for the time being, except for matters specified in Article 1 of the Cabinet Office Ordinance (Cabinet Office Ordinance No. 11 of 2015) which stipulates allergens, expiration dates, whether or not heating is required for safe consumption of food, and other matters that have an important impact on the safety of consuming food, as stipulated in Article 6, Paragraph 8 of the Food Labeling Act. Even if there is a discrepancy between the information displayed on the container and packaging based on the Food Labeling Standards, such as raw materials, place of origin of raw materials, or amount of nutrients, and the information displayed on the actual raw materials used, place of origin of raw materials, or amount of nutrients obtained from said raw materials, if the correct information about the raw materials and other aspects of the food is communicated to general consumers in a timely and appropriate manner through notices in stores, company announcements, website postings, etc., we ask for your appropriate response. Furthermore, we would like to add that this notice does not preclude enforcement against malicious violations that take advantage of the situation to deceive ordinary consumers.
